Lone Grove — A 58-year-old local man arrested Saturday afternoon following a sexual assault on a child has been charged in Carter County District Court.

District Attorney Craig L add confirmed Tuesday he had filed a charge of first-degree rape against Miley Strayer. Strayer made an initial appearance before Special District Judge Thomas Baldwin Tuesday afternoon. Bond was set a $250,000.

Court documents indicate Strayer is charged with raping a girl at a Lone Grove residence. The charge accuses him of using “force, threats or violence, or by means of threats of force or violence accompanied by the apparent power of execution” to carry out the rape. The charge also carries a “Page II” (after former conviction penalty en­hancement) pointing to Strayer’s previous convic­tions in Muskogee County District Court of neglect of a child, pos­session of controlled dangerous substance (metham­phetamine) with intent to distrib­ute and sec­ond-degree burglary.

Strayer was arrested by Lone Grove police about an hour af ter officers re­sponded to a report of a sexual assault on a minor. When officers arrived at the residence about 1:15 p.m. they found the vic­tim and an eye witness to the crime. Strayer had fled the scene on foot. He was captured on Newport Road about an hour later and was arrested without incident. Strayer was im­mediately booked into the Carter County Detention Center pending the filing of formal charges.

Department of Human Services Child Welfare workers were called to the scene. Subsequently the Carter County Multidis­ciplinary Team assisted in the investigation.

A CCDC spokesperson said Tuesday afternoon Strayer remained detained pending the posting of bond and or the outcome of the case.

If convicted he faces not less than five years in a state prison.
